Consumer Terms & Conditions of Sale

1. OUR CONTRACT

1.1 These Terms and Conditions (“Terms”) apply to all purchases made by consumers from Housefix Direct Ltd (“we”, “us”, “our”).

1.2 You are a consumer if you are purchasing goods wholly or mainly for personal, domestic, or household use.

1.3 By placing an order, you agree to be bound by these Terms.

1.4 A legally binding contract is formed when:

  • we accept your order, and
  • payment has been received, and
  • we confirm dispatch or release of goods

1.5 Order confirmations or automated emails do not constitute acceptance.

1.6 We may refuse or cancel orders prior to dispatch for reasons including stock issues, pricing errors, or suspected fraud.


2. YOUR RIGHTS AS A CONSUMER

2.1 Nothing in these Terms affects your statutory rights under UK law, including:

  • Consumer Rights Act 2015
  • Consumer Contracts Regulations 2013

2.2 These laws give you rights relating to:

  • goods being as described
  • goods being of satisfactory quality
  • goods being fit for purpose

2.3 If goods are faulty or misdescribed, you may be entitled to a repair, replacement, or refund.


3. PRICES & VAT

3.1 Prices are as displayed at the time of order.

3.2 Prices may be shown inclusive or exclusive of VAT depending on display format.

3.3 VAT is charged at the applicable rate at the time of checkout.

3.4 We reserve the right to correct pricing errors prior to acceptance of your order.

3.5 If a pricing error occurs, we may:

  • cancel your order and refund you, or
  • offer you the option to proceed at the correct price

4. PAYMENT

4.1 Payment must be made in full at the time of ordering.

4.2 We accept major debit/credit cards and other payment methods as shown at checkout.

4.3 We are not obliged to dispatch goods until payment has cleared.

4.4 Payment processing is subject to validation and authorisation checks.

4.5 If payment is declined or fails authorisation, your order will not be accepted.


5. DELIVERY

5.1 Delivery times are estimates only and not guaranteed.

5.2 We aim to deliver within the timeframe shown at checkout.

5.3 Risk in the goods passes to you upon delivery.

5.4 It is your responsibility to ensure:

  • correct delivery address
  • safe access to the property
  • availability to receive goods

5.5 We are not responsible for delays outside our control.

5.6 We are not responsible for unpacking, installation, or disposal of packaging.


6. CLICK & COLLECT

6.1 You may collect goods from selected locations where available.

6.2 Collection may require:

  • order confirmation
  • payment card verification or ID
  • collection code

6.3 Orders must be collected within 21 days unless otherwise stated.

6.4 If not collected, orders may be cancelled and refunded.


7. INSPECTION & DELIVERY ISSUES (24-HOUR REPORTING)

7.1 You should inspect goods as soon as reasonably possible after delivery or collection.

7.2 If goods are:

  • damaged
  • missing
  • incorrect

you should notify us within 24 hours of receipt.

7.3 This 24-hour notification requirement helps us:

  • investigate courier issues
  • resolve problems quickly
  • protect both parties from delivery errors

7.4 This requirement does NOT affect your statutory rights.

7.5 You may still be entitled to remedies under consumer law even after this period.


8. RETURNS & CANCELLATION RIGHTS

8.1 Cooling-Off Period (14 Days)

8.1.1 You have the right to cancel your order within 14 days of receiving goods.

8.1.2 You do not need to give a reason.

8.1.3 You then have a further 14 days to return the goods.

8.2 Condition of Returned Goods

8.2.1 To receive a full refund, goods must be:

  • unused
  • in original sealed packaging
  • in resalable condition
  • complete with all parts and accessories

8.2.2 We may reduce refunds if goods show signs of use beyond what is necessary to inspect them.

8.3 Return Costs

8.3.1 You are responsible for return postage costs unless goods are faulty or incorrect.


9. FAULTY OR INCORRECT GOODS

9.1 If goods are faulty or not as described, you are entitled to a repair, replacement, or refund.

9.2 Within the first 30 days, you may be entitled to reject goods for a full refund.

9.3 After 30 days, we may offer:

  • repair
  • replacement
  • partial refund

9.4 We may require evidence (such as photos) to assess faults.


10. NON-RETURNABLE GOODS

The following cannot be returned unless faulty:

  • made-to-order goods
  • cut or mixed materials
  • installed or partially installed goods
  • sealed hygiene-sensitive goods once opened
  • clearance items (if clearly stated at purchase)

11. MANUFACTURER WARRANTIES

11.1 Some products include a manufacturer’s warranty.

11.2 These warranties are provided by the manufacturer, not us.

11.3 We are not responsible for:

  • warranty claims
  • repair delays
  • manufacturer decisions
  • warranty administration

11.4 Some warranties require registration within a set timeframe.


12. LIABILITY

12.1 We are not liable for:

  • loss of income
  • loss of business
  • indirect or consequential losses

12.2 Nothing in these Terms excludes liability for:

  • death or personal injury caused by negligence
  • fraud
  • your statutory rights

12.3 Our liability is limited to the value of goods purchased.


13. FORCE MAJEURE

We are not responsible for delays caused by events outside our control, including supply chain disruption, transport issues, or natural events.


14. DISPUTES & EVIDENCE

14.1 We keep detailed records including:

  • order history
  • payment confirmation
  • dispatch logs
  • courier tracking

14.2 These records may be used to resolve disputes.

14.3 In delivery disputes, courier tracking and proof of delivery will normally be considered evidence of completion.


15. CHARGEBACKS & PAYMENT DISPUTES

15.1 If you have a problem with your order, you must contact us first before raising a payment dispute.

15.2 We will investigate and attempt to resolve the issue promptly.

15.3 Unauthorised chargebacks may result in:

  • suspension of account
  • recovery of fees
  • legal or collection action where appropriate

16. ENTIRE AGREEMENT

16.1 These Terms form the entire agreement between us.

16.2 You should not rely on any verbal statements outside this document.


17. GOVERNING LAW

These Terms are governed by English law and subject to the exclusive jurisdiction of the courts of England and Wales.
